To sign up for L2S, you must read and accept the Acceptable Use Policy.
L2S wireless Internet Service is provided by Interstate Communications. The L2S Acceptable Use Policy has been formulated with the following goals in mind:
• Ensure security, reliability, and privacy of the L2S systems and network, and the networks and systems of others
• Avoid situations that may cause L2S to incur civil liability
• Maintain the image and reputation of L2S as a responsible provider
• Preserve the value of Internet resources as a conduit for free expression
• Encourage the responsible use of net resources, discouraging practices which degrade the usability of network resources and thus the value of Internet services
• Preserve the privacy and security of individual users
    
General Terms and Conditions
1. By signing this order and agreement, you (Customer) agree to the terms and conditions of the L2S Customer Service Agreement and the L2S Acceptable Use Policy (collectively, Customer Agreement). L2S may modify its Customer Service Agreement and Acceptable Use Policy from time to time and shall provide you notice of such changes by Website publication, bill message or other commercially reasonable notice.

2. These services are provided by Interstate Communications doing business as Licensed To Speed (L2S).3. Internet Accounts are assigned to individual Customers only. Only one user can access each individual account at a time.4. All charges are billed monthly. Payment is due upon receipt of invoice. Accounts are in default if payment is not received within 21 days after date of invoice. If Customer payment is returned unpaid, Customer account is immediately in default and subject to a returned check charge of $20 from L2S. Accounts unpaid 30 days after date of invoice may have their service disconnected. Disconnection does not relieve you from the obligation to pay the monthly charge. A reconnect fee of $40 will be charged to restore service. Only a written request to terminate your service provided by L2S relieves you of your obligation to pay the monthly account charge. If you default, you agree to pay L2S its reasonable expenses, including attorney and collection agency fees, incurred in enforcing its rights under the Customer Agreement. L2S reserves the right to change the rate schedule at any time and shall provide you notice of such changes by Website publication, bill message or other commercially reasonable notice.

5. L2S make no attempt to verify accurate receipt of any message and is not responsible for any loss of data resulting from delays, non-deliveries, incorrect deliveries, viruses, E-mail filtering or service interruptions, including those caused by negligence, errors or omissions of L2S, nor for consequential damages, regardless of their cause.6. L2S provides a Toll free number and a local access telephone number and is not liable for any long distance charges Customer may incur.7. Customer agrees to comply with the terms governing use of the L2S network and services.8. L2S reserves the right to limit the size of Customer’s e-mail storage to 50 MB.9. This Customer Agreement shall be governed by and construed in accordance with the laws of the State of Iowa applicable to contracts to be performed entirely within the state.10. In the event Customer disconnects from L2S or otherwise terminates this contract before the expiration of the term set forth in this Customer Agreement, Customer hereby agrees to pay to L2S $200 and return the radio equipment in working order. If radio equipment is not returned within 30 days of termination of service by Customer, L2S will bill Customer $600 for the unreturned radio equipment.
11. It is expressly agreed and understood that L2S is not responsible for the information which may be accessed or received through the Internet and L2S does not warrant the accuracy or appropriateness of any information. Customer agrees to hold harmless L2S, its directors, officers and employees from any and all claims, which might arise from Customer’s use of the Internet.12. Customer is executing this Customer Agreement solely in reliance upon Customer’s own knowledge, belief and judgment and no upon any representations made by L2S.13. Customer agrees that L2S is only responsible for delivering the service to a single computer. Installation of service to additional computers or computer networks is the responsibility of Customer.14. Customer agrees that L2S is not responsible for providing any type of anti-virus, firewall or filtering software. Setup, maintenance and use of such programs shall be solely Customer’s responsibility.15. L2S services are for use by the account owner/Customer only and may not be resold, or assigned to a third party. Therefore, L2S services may not be extended beyond the account owner/Customer’s premise.

16. Customer agrees to hold harmless L2S and its directors, officers, agent and employees from all claims, demands and causes of action of every nature or kind, caused by, arising from or developing out of or as a result of any act or failure to act by L2S, whether or not negligent, in connection with the installation, maintenance, failure, removal, or use of any equipment, software or service provided by L2S hereunder. Customer expressly assumes all risks associated with installation and connection and L2S assumes no responsibility and expressly disclaims all liability for any damage to, or loss or destruction of your computer or any other hardware, software or equipment.

17. L2S MAKES NO WARRANTY, EXPRESS OR IMPLIED AS TO ANY EQUIPMENT, SOFTWARE OR SERVICE, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AND ALL EQUIPMENT, SOFTWARE, AND SERVICES ARE SUPPLIED ON AN "AS IS", “AS AVAILABLE” BASIS. IN NO EVENT SHALL L2S BE LIABLE FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSSES OR DAMAGES ARISING IN ANY MANNER OUT OF THE INSTALLATION, MAINTENANCE, FAILURE, REMOVAL, OR USE OF THE EQUIPMENT, SOFTWARE OR SERVICE PROVIDED BY L2S HEREUNDER. IN ANY EVENT, L2S’S TOTAL LIABILITY UNDER THIS AGREEMENT FOR DAMAGES, COSTS AND EXPENSES, REGARDLESS OF CAUSE, SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID TO COMPANY BY CUSTOMER. THIS LIMITATION SHALL APPLY TO ALL CLAIMS OF CUSTOMER OF ANY NATURE. NO REPRESENTATION, COMMUNICATION OR STATEMENT, WHETHER IN WRITTEN OR ORAL FORM, BY ANY L2S EMPLOYEE OR AGENT SHALL BE CONSTRUED TO ADD TO OR MODIFY ANY REPRESENTATIONS OR WARRANTIES HEREIN.

 
Acceptable Use

The Acceptable Use Policy below defines the actions that L2S considers to be abusive, and thus, strictly prohibited. The examples named in this list are non-exclusive and are provided solely for guidance to Customers. If you are unsure whether any contemplated use or action is permitted, please send e-mail to support@L2Speed.net and we will assist you.

Please note that the actions listed below are also not permitted from other Internet Service Providers on behalf of, or to advertise, any service hosted by L2S, or connected via L2S’s networks. Furthermore, such services may not be advertised via deceptive marketing policies, as defined by the Federal Trade Commission Deception Policy Statement.

         
General Conduct

1. Customers are prohibited from transmitting on or through any of L2S’s services or networks, any material that is, in L2S’s sole discretion, determined to be unlawful, obscene, threatening, abusive, libelous, or hateful, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.

2. L2S’s services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. L2S reserves the right to remove such illegal material from its servers.

3. Customer is responsible for keeping all billing data with L2S up-to-date and accurate. Furnishing false data on the signup form, contract, or online application, including fraudulent use of credit card numbers, is grounds for immediate termination and may subject the offender to civil or criminal liability.

4. The resale of the L2S’s products and services is not permitted, except as specifically permitted and documented in a written agreement.

5. Activities that violate local, state, or federal statutes are prohibited.

        
Copyright Infringement

1. Customers may not use L2S’s network to transmit any material (by E-mail, uploading, downloading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

System and Network Security

1. Customers may not attempt to circumvent user authentication or security of any host, network, or account ("cracking"). This includes, but is not limited to, accessing data not intended for the Customer, logging into a server or account the Customer is not expressly authorized to access, or probing the security of other networks (such as running a SATAN scan or similar tool).

2. Customers may not attempt to interfere with service to any user, host, or network ("denial of service attacks"). This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.

3. Customers may not use any kind of program/script/command, or send messages of any kind, designed to interfere with a user’s terminal session, via any means, locally or by the Internet.

4. Users who violate systems or network security may incur criminal or civil liability. L2S will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

5. Activities that violate local, state, or federal statutes are prohibited.

      
Domain Names

L2S provides domain name service for Dedicated Connection Accounts. Keeping registry information updated and accurate is the responsibility of the domain holder and not the L2S.

1. Customers shall not falsify or omit valid domain contact information, including the administrative, technical, zone, and billing contacts.

2. Activities that violate local, state, or federal statutes are prohibited.

     
E-mail

1. Harassment, whether through language, frequency, or size of messages, is prohibited.

2. Customers may not send E-mail to any person who does not wish to receive it. If a recipient asks to stop receiving E-mail from Customer, Customer must not send that person any further E-mail.

3. Customers are explicitly prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. Such material may only be sent to those who have explicitly requested it.

4. Customers may not forward or otherwise propagate chain letters, whether or not the recipient wishes to receive such mailings.

5. Malicious E-mail, including, but not limited to, "mailbombing" (flooding a user or site with very large or numerous pieces of E-mail), is prohibited.

6. Forging of header information is not permitted.

7. L2S’s accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider.

8. These rules apply to other types of Internet-based distribution mediums as well, such as RLG’s Ariel system (a system for sending FAX-like documents over the Internet). USENET postings have their own regulations; see below.

9. Activities that violate local, state, or federal statutes are prohibited.

   
USENET

1. L2S provides an uncensored newsfeed. As such, L2S does not control the content of the newsgroups available to its Customers. L2S is not responsible for the content of any USENET posting, whether or not the posting was made by a Customer of L2S.

2. Postings to USENET newsgroups must comply with the written charters or FAQs (Frequently Asked Questions) for those newsgroups. Advertisements should only be posted in those newsgroups whose charters/FAQs explicitly permit them. The poster is responsible for determining the etiquette of a given newsgroup, prior to posting to it.

3. Customers are prohibited from posting the same or similar message to large numbers of newsgroups (excessive cross-posting or multiple-posting, also known as "USENET spam").

4. Customers are prohibited from posting chain letters of any type.

5. Customers are prohibited from posting binary files to newsgroups not specifically named for that purpose.

6. Customers are prohibited from canceling or superseding posts other than their own, with the exception of official newsgroup moderators performing their duties.

7. Customers are prohibited from forging header information. This includes attempting to circumvent the approval process for posting to a moderated newsgroup.

8. Customers may not solicit mail for any other address other than that of the Customer’s account or service, with the intent to harass or collect replies after the L2S’s service has been terminated.

9. Activities that violate local, state, or federal statutes are prohibited.

 
IRC (Internet Relay Chat)

1. L2S is not liable for the content of any communications made on IRC.

2. IRC robots ("bots" or "clones") may not be run from L2S’s shell accounts.

3. Customers may not attempt to impersonate others or use IRC anonymously by disguising their hostname or username.

4. Customers are prohibited from using IRC scripts or programs that interfere with or deny service to other users on any server or host. Customers are also prohibited from engaging in activities which harass other users. This includes, but is not limited to, "flooding" (rapidly entering text with the intent to fill the screens of others), "flashing" (disrupting terminal emulation), "takeovers" (forcibly seizing operator privileges), attempting to send private messages to those who do not wish to see them (via "ignore"), attempting to return to a channel after being banned from it, and other disruptive behaviors.

5. Activities that violate local, state, or federal statutes are prohibited.
